Welcome to Hopeway Stores. These Terms and Conditions (“Terms”) govern your access to and use of the website hopewaystores.com and the Hopeway Stores mobile application (collectively, the “Service”), operated by Hopeway Stores (“we,” “our,” or “us”), a grocery ordering and delivery platform serving Riyadh, Saudi Arabia.
By creating an account, placing an order, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 18 years old and capable of entering into a legally binding contract to use the Service. By using the Service, you confirm that you meet these requirements.
2. Account Registration
- You must provide accurate, current, and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You agree to notify us immediately of any unauthorized use of your account.
- We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
3. Orders and Availability
- Product listings, prices, and availability are subject to change without prior notice.
- Placing an order through the Service constitutes an offer to purchase, which we may accept or decline at our discretion (e.g., due to stock unavailability, pricing errors, or delivery-area limits).
- We make reasonable efforts to ensure product descriptions and images are accurate but do not guarantee they are error-free.
- Order confirmation via the app/website or SMS does not guarantee delivery of every item if it becomes unavailable; substitutions or refunds may apply per our order policy.
4. Pricing and Payment
- All prices are listed in Saudi Riyal (SAR) and are inclusive/exclusive of VAT as indicated at checkout.
- Payment must be made through the payment methods supported on the Service (e.g., credit/debit card, cash on delivery, or digital wallets, as applicable).
- We reserve the right to correct pricing errors and to cancel orders placed at an incorrect price, with a full refund where payment was already made.
- Delivery fees, service fees, or minimum order requirements may apply and will be disclosed before checkout.
5. Delivery
- Delivery times provided are estimates and not guaranteed; delays may occur due to traffic, weather, high demand, or circumstances beyond our control.
- You are responsible for providing an accurate delivery address and being reasonably available to receive the order.
- Risk of loss and title for products pass to you upon delivery.
- If delivery cannot be completed due to an incorrect address or unavailability of the customer, additional fees may apply for redelivery.
6. Cancellations, Returns, and Refunds
- Orders may be canceled prior to dispatch by contacting customer support.
- Perishable and grocery items are generally non-returnable once delivered, except in cases of damaged, incorrect, or missing items.
- Refunds for eligible issues (damaged/incorrect/missing items) will be processed to the original payment method within a reasonable time after verification.

7. User Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Provide false, misleading, or fraudulent information.

- Misuse promotional codes, discounts, or referral programs.
We reserve the right to suspend or terminate access for users who violate these Terms.

To the fullest extent permitted by applicable law, Hopeway Stores shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to delays, product unavailability, or delivery issues, except where caused by our gross negligence or willful misconduct.
11. Indemnification
You agree to indemnify and hold harmless Hopeway Stores, its owners, employees, and partners from any claims, damages, or expenses arising from your misuse of the Service or violation of these Terms.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, us, or third parties.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in Riyadh, Saudi Arabia.
